Mott submits financial records requested by Borough Authority

Brenda Mott, who the state says stole over $500,000 from the Canton Borough Authority, is providing numerous financial documents to the authority’s attorney, so a motion that would have forced those documents to be turned over has been withdrawn, the authority’s solicitor said on Tuesday.

On Nov. 24, Lee C. Swartz, who is the authority’s lead attorney in its civil lawsuit against Mott, had filed a motion in the Bradford County Court of Common Pleas that would have required Mott to comply with an October 2007 court order, which directed her to turn over numerous financial documents.

William Hebe, the attorney representing Mott, “produced a lot of documents, so the motion was withdrawn” on Tuesday, Canton Borough Authority Solicitor Matthew Brann said.

In a conference call on Tuesday involving the judge and lawyers in the case, Hebe said he has produced “the documents that we were looking for,” Brann said.

Swartz had said he needed the financial documents in order to depose Mott.

In a related matter, a court hearing on the Commonwealth’s proposal to modify Mott’s restitution payment plan, which was scheduled for Dec. 30, has been postponed to Jan. 6.

The 53-year-old Mott, who is the authority’s former bookkeeper, had pleaded guilty in 2005 to four felony charges involving the theft of money from the authority over a six-year period.

" There is a world of difference between producing "a lot of documents", and making open, honest revelation of pertinent data. The devil is in the details, and the public is entitled to know those details sooner rather than later. Given it took over a year for authorities to react to the initial document production failure, one wonders just how serious is effort to recover the people's money.

My opinion, and it's no more than that, is this situation in the aggregate is becoming, or already has become, a farce. "

" Will the amount of restitution include penalties and interest? As for the Canton burough, how did it operate for so long with a $500,000 hole in the budget. Four felonies, since 2005, what a joke. "

" I saw an article in the Daily Review that stated Brenda Mott was paying $200 per month for her restitution payment plan. I wonder if this is the amount they are trying to change. I pay $200 a month car payment for my nine-year-old car! If I could get my hands on half a million dollars and get to pay it back at $200 - give me a pen and show me where to sign! "

" I have and always will be proud to be an American and especially a rural American where a handshake and a look in the eye was the end all. I maintain"you can not legislate morality" one does not have to wonder why, just glance at the morality in the legislature, the executive and in this case surrounded by the judicial and the possible appearance of impropriety, real or not. "Farce"as Ned puts it,sums up the moral decay that we have let invade our lives. Being honest and forthright with love for our fellow man, should help save us as a civilization. We also need to reprove the miscreants with sharpness, which appears to be a lost art, only when enough pressure is applied is misbehavior reduced. For the new year I hope each of us will become less complacent and set out to truly help straighten things out. The process isn't going to be done by gov't leaders, for the most part, they have become too self serving, we need to hold them and ourselves accountable,God help us...he is the only one that can and he won't if we don't put forth effort and accept what we might have to change in our ways. HAPPY NEW YEAR "

" lets face it this whole Brenda Mott thing has been a joke from the start if they would of been harder on her and had the answers from the start I think the people of Canton would of been more forgiving but she was treated special and that wont be forgotten for a long time if forgotten at all. And then the icing on the cake is they just bought a new home in Cogan Station for 250,000 dollars and where did that Money come from. If they can afford to buy a new home for that much money Brenda Mott can afford to pay back more than the 200 a month she is paying now. What is wrong with the home they have now? I think they are just running away from their problems. Have seen her around and not a very friendly person never comes into the Boro of Canton she is always seen headed south towards Williamsport. She stole from us and now she cant even face the people of canton. I was brought up that if you do wrong then you pay the price even if it is going to jail. Be accountable for your actions,oh yes I forgot they had a name in this town an those people get special treatment have seen this many times in the last 30 years i have lived in canton. "

" Cathy, if you find out how to get this $500,000 loan at $200 a month payment, let us know! Of course, we probably don't have the name... but maybe Brenda could co-sign for us!
Of course, we would need to spend a VERY short time in minimum security, but we'd have a work release... to work at our own lawyer's office, if we matched the penalty with her.
But that's a dream, isn't it? If you or I would have done the same crime, we'd be in jail for a very long time, paying full restitution.
Only a smidgen of justice was served when John was not re-elected. No problem for them, as they just ran to a new mini-mansion, and picked up a law practice with a Williamsport firm.

Answers still need to be provided, and restitution is due, not only to the Authority but also to the people of Canton Boro. Surely, our water and sewer bills have been higher due to this scam, and remain so.
More importantly, what was passed over in the way of improvements and water treatment for the Boro due to this theft? What wasn't done, because the money 'wasn't there'?... Will anyone ever know?

Perhaps a sharp lawyer, unafraid of the supposed judicial 'inside' clout that John has, will someday file a class action suit on behalf of the people of Canton Borough. Seize all assets, sell them off, and give us back our money. Our health, on the other hand, is sadly lost forever. "

I had to look three (3) times to make sure I was seeing what I saw: A ring so big & shiny that it almost blinded me!
Why couldn't she sell her trinkets to pay the bills she duefully owes the fine people of Canton?
How is that their house did not have a liene put on it?
If you or I owed a bill, it would be turned over to a bill collector & we would have had to pay more then a mere $200 a month...what a slap in the face. SELL THE RING BRENDA! "

Doesn't her 4 felonies count for anything? Oh, thats right, she a judges wife! It must not apply to those people. "

" linda FNA I think strikes require a break or adjudication between them to be second or subsequent although there were many counts , it was reduced to four.... why we don't know, OH & what about the IRS has anybody ask them?? Sally, misstatements really? and your definition of meanspiritedness {your spelling} is? OMG thought this whole thing was a dead horse, glad your still with us, I always enjoy your insight as long you don't incite, as some may think I try to. People really do need an avenue to vent, these post are basically harmless and should be taken with several grains of salt, AND who knows they may even help prevent wrong doing,as some may decide it's not worth the embarrassment, though you can see many don't think the penalty "as levied" would act as any determent for this kind of cash. Justice.... Justice for all, hope you're around at election time. nite all. "

Sally wrote on Jan 6, 2009 10:39 PM:

" OK. How about "they just bought a new home for $250,000.00'"- untrue by your own reports.

"not a very friendly person, never comes into Boro of Canton" - meanspirited and untrue, I just saw her recently participating in a Christmas eve church service in Canton Boro, I see her in town frequently, and she's always very friendly.

"put them both in jail" - meanspirited and unamerican. Here we don't punish one person for what another did. That's what they do in China.

"I sat next to Brenda Mott ..... saw a ring so big and shiny it almost blinded me" - Not true. I was there. I am pretty sure there is no such ring, and even if there were one, I know she did not have it on that night.

Enough?

EDITOR'S NOTE: To be precise, the purchase price we reported was $240,000.

Here is the complete entry regarding the ring:

"I sat nex to Brenda Mott the night her husband lost his seat in the court house. I had to look three (3) times to make sure I was seeing what I saw: A ring so big & shiny that it almost blinded me! Why couldn't she sell her trinkets to pay the bills she duefully owes the fine people of Canton? How is that their house did not have a liene put on it? " Mr. Hosie,
There is not enough space here to actually cite all of the misrepresentation of the facts, slanted reporting, and out-right lies that you have sold to the citizens of Bradford County regarding this case. Your articles and editorials have been infested with your biased opinions and out-right lies. You respond to posts critical of you by asking for specific details. Why do you not respond to posts critical of the Mott's in the same way? Challenge those that spread lies and rumors in the same fashion that you confront those that ask questions about your lies that you attempt to sell as news and honest reporting.

EDITOR'S NOTE: You are entitled to your opinion, which we publish for all to read, unsubstantiated, off base and anonymous though it is. "
