Bradford County District Attorney Daniel J. Barrett announced that the following persons were sentenced in the Bradford County Court of Common Pleas, Towanda, Pa.:

Brian D. May, 45, of Canton, Pa., was sentenced by Judge Jeffrey Smith to a total term of Imprisonment in the Bradford County Correctional Facility of from 37 days to 23 months, 29 days, and a total fine of $1,500, for burglary, a felony of the second degree, and driving under the influence of alcohol, a misdemeanor. May was also ordered to pay restitution of $863 and he will lose his Pennsylvania driving privilege for 12 months. Troopers Andrew Burian and Deanna Piekanski of the Pennsylvania State Police arrested May for the offenses in May and June 2009, respectively, after incidents in Canton Township. May may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Bradford County Probation Department.

Paul L. Roberts, 28, of Towanda, Pa., was sentenced by Judge Jeffrey Smith to Restrictive Intermediate Punishment consisting of imprisonment in the Bradford County Correctional facility of 28 days followed by five months and two days on house arrest under electronic supervision, and a fine of $500, for driving under the influence of alcohol, a misdemeanor. Roberts will also lose his Pennsylvania driving privilege for 12 months. Trooper Deanna Piekanski of the Pennsylvania State Police arrested Roberts for the offense in February 2009 after an incident in North Towanda Township. While under electronic supervision Roberts will be subject to monitoring by the Bradford County Probation Department.

Brett M. Cooley, 21, of Tunkhannock, Pa., was resentenced by Judge Jeffrey Smith to probation for a term of two years, and a fine of $300, for criminal conspiracy to commit theft by unlawful taking, a misdemeanor of the second degree. Trooper Brian Atherholt of the Pennsylvania State Police arrested Cooley for the offense in September 2007 after an incident in Wyalusing Borough. While on probation, Cooley will be subject to supervision and monitoring by the Bradford County Probation Department. Cooley was originally sentenced to probation for a term of 12 months for the offense but probation was revoked due to violation of conditions of probation.

Leighann J. Cobb, 22, of Wyalusing, Pa., was sentenced by Judge Jeffrey Smith to a term of imprisonment in the Bradford County Correctional Facility of from four days to six months, and a fine of $1,000, for driving under the influence of alcohol, a misdemeanor. Cobb will also lose her Pennsylvania driving privilege for 12 months. Trooper Matthew Knock of the Pennsylvania State Police arrested Cobb for the offense in April 2008 after an incident in Wysox Township. Cobb may be eligible for parole after serving the minimum sentence, and, if paroled, she will be subject to supervision and monitoring by the Bradford County Probation Department.

Glenn R. Vanboven Jr., 37, of Athens, Pa., was sentenced by Judge Jeffrey Smith to a term of imprisonment in the Bradford County Correctional Facility of from five days to six months, and a fine of $1,000, for driving under the influence of alcohol, a misdemeanor. Vanboven will also lose his Pennsylvania driving privilege for 12 months. Trooper Matthew Knock of the Pennsylvania State Police arrested Vanboven for the offense in May 2009. Vanboven may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Bradford County Probation Department.

Aaron Saxon, 21, of Monroeton, Pa., was sentenced by Judge Jeffrey Smith to a term of imprisonment in a Pennsylvania State Correctional Facility of from four months to 30 months, and a fine of $500, for conspiracy to commit theft by unlawful taking, a misdemeanor of the first degree. Saxon was also ordered to pay restitution of $1,295.39. Trooper Robert McKee of the Pennsylvania State Police arrested Saxon for the offense in May 2009 after an incident in Towanda Township. Saxon may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Pennsylvania Board of Probation and Parole.

Carl Mosier, 22, of Sayre, Pa., was sentenced by Judge Jeffrey Smith to County Intermediate Punishment for a term of 12 months with house arrest under electronic monitoring for 60 days, and a fine of $500, for unauthorized use of a motor vehicle, a misdemeanor of the second degree. Trooper Robert McKee of the Pennsylvania State Police arrested Mosier for the offense in July 2007 after an incident in Ulster Township. While on County Intermediate Punishment, Mosier will be subject to supervision and monitoring by the Bradford County Probation Department.

Sarah Mosier, 19, of Mehoopany, Pa., was sentenced by Judge Jeffrey Smith to Probation for a term of one year, and a fine of $500, for possession of a controlled substance, a misdemeanor. Mosier will also lose her Pennsylvania driving privilege for six months. Agents of the Pennsylvania State Police Vice and Narcotics Unit arrested Mosier for the offense in March 2009 after an incident in Tuscarora Township. While on probation, Mosier will be subject to supervision and monitoring by the Bradford County Probation Department.

Matthew Gay, 18, of Waverly, N.Y., was sentenced by Judge Jeffrey Smith to probation for a total term of three years, and a total fine of $1,250, for theft by deception, a misdemeanor of the first degree, and theft by unlawful taking, a misdemeanor of the second degree. Gay was also ordered to pay restitution of $1,555.37. Officer Denny Slater of the Athens Township Police Department arrested Gay for the offenses in October 2008 and April 2009 after incidents in Athens Township. While on probation, Gay will be subject to supervision and monitoring by the Bradford County Probation Department.

Bradford County District Attorney Daniel J. Barrett announced that the following persons entered pleas of guilty in the Bradford County Court of Common Pleas, Towanda, Pa.:

Brett J. Sawyer, 30, of Troy, Pa., entered a plea of guilty to criminal use of a communication facility, a felony of the third degree, and corruption of minors, a misdemeanor of the first degree. Sawyer will be sentenced in January 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Sawyer faces a maximum sentence of up to 12 years, plus fine(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Trooper Nathan Lewis of the Pennsylvania State Police arrested Sawyer for the offense in September 2009 following investigation of an incident that occurred in South Creek Township.

Matthew Gay, 18, of Waverly, N.Y., entered a plea of guilty to theft by deception, a misdemeanor of the first degree.

Gay will be sentenced on Nov. 5, 2009, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Gay faces a maximum sentence of up to five years plus fine(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Officer Denny Slater of the Athens Township Police Department arrested Gay for the offense in April 2009, following investigation of a theft that occurred in Athens Township.

Calvin Forrest Jr., 21, of Towanda, Pa., entered a plea of guilty to driving under the influence of alcohol, a misdemeanor. Forrest will be sentenced on Dec. 21, 2009, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Forrest faces a maximum sentence of up to six months plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 12 months, and any other conditions deemed appropriate by the sentencing court. Trooper Nathan Lewis of the Pennsylvania State Police arrested Forrest for the offense in December 2009 following investigation of a traffic incident that occurred in Burlington Township.

Chad M. Gardner, 23, of Campbell, N.Y., entered a plea of guilty to driving under the influence of alcohol, a misdemeanor; speeding, a summary offense; and passing in a no-passing zone, a summary offense. Gardner will be sentenced on Jan. 4, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Gardner faces a maximum sentence of up to six months plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 12 months, and any other conditions deemed appropriate by the sentencing court. Corporal Michael Giantisco of the Pennsylvania State Police arrested Gardner for the offense in April 2009 following investigation of a motor vehicle crash that occurred in Columbia Township.

Shelly L. Baltimore, 46, of Gillett, Pa., entered a plea of guilty to theft by unlawful taking, a misdemeanor of the first degree. Baltimore will be sentenced on Jan. 4, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Baltimore faces a maximum sentence of up to five years plus fine(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Trooper David Pelachick of the Pennsylvania State Police arrested Baltimore for the offense in July 2009 following investigation of an incident that occurred in Ridgebury Township.

William Heath, 37, of Wellsboro, Pa., entered a plea of guilty to driving under the influence of alcohol, a misdemeanor. Heath will be sentenced on Jan. 4, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Heath faces a maximum sentence of up to six months plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 12 months, and any other conditions deemed appropriate by the sentencing court. Officer Brian Wibirt of the Canton Borough Police Department arrested Heath for the offense in July 2007 following investigation of a motor vehicle crash that occurred in Canton Borough.

Scott King, 28, of Towanda, Pa., entered a plea of guilty to corruption of minors, a misdemeanor of the first degree.

King will be sentenced on Jan. 4, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, King faces a maximum sentence of up to five years plus fine(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Trooper Robert McKee of the Pennsylvania State Police arrested King for the offense in March 2009 following investigation of a situation that occurred in Ridgebury Township.

Norman Zamarche, 48, of Meeker, Okla., entered a plea of guilty to simple assault, a misdemeanor of the second degree.

Zamarche will be sentenced on Jan. 4, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Zamarche faces a maximum sentence of up to two years plus fine(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Officer Richard Horton of the Athens Township Police Department arrested Zamarche for the offense in August 2009 following investigation of an assault that occurred in Athens Township.

Bradford County District Attorney Daniel J. Barrett announced that the following persons were sentenced in the Bradford County Court of Common Pleas, Towanda, Pa.:

Norman Derrig, 48, of Athens, Pa., was sentenced by Judge Jeffrey Smith to a fine of $200 for disorderly conduct, a summary offense. Officer Derek Dekar of the Athens Borough Police Department arrested Derrig for the offense in March 2009 after an incident in Athens Borough.

Bradford County District Attorney Daniel J. Barrett announced that the following person entered a plea of guilty and was sentenced in Magisterial District Court on Nov. 12:

Fawn E. Greene, 25, of Canton, Pa., entered a plea of guilty before Magisterial District Judge Jonathan Wilcox to unsworn falsification to authorities, a misdemeanor of the third degree, and harassment, a summary offense, and was sentenced to pay a fine for each offense. Troopers Joshua Fisher and Joseph Longmore of the Pennsylvania State Police arrested Greene for the offenses in July and August 2009, respectively, following investigation of incidents that occurred in Canton Borough and Canton Township.

Bradford County District Attorney Daniel J. Barrett announced that the Superior Court of Pennsylvania recently denied the following person's appeal filed in connection with a conviction in the Bradford County Court of Common Pleas:

Bianca Brooks, 25, of Elmira, N.Y., appealed in connection with her conviction at criminal trial by jury in 2007. In her appeal, Brooks alleged that her attorney was ineffective at trial by failing to present an alibi defense. The Superior Court, after considering Brooks' argument, concluded that she had not provided her attorney with sufficient information to enable him to present an alibi defense and denied her appeal.
