Bradford County District Attorney Daniel J. Barrett announced that the following persons plead guilty and were sentenced in Magisterial District Court 42-3-01, Troy:
Dale D. Stranger, 35, Monroeton, entered a plea of guilty before Magisterial District Judge Timothy Clark to disorderly conduct, a misdemeanor of the third degree, and was sentenced to pay a fine of $100 and court costs. Trooper Benjamin Bigus of the Pennsylvania State Police arrested Stranger for the offense in January 2010 following an incident in Monroe Township.
Misty L. Smith, 34, Mildred, Pa., entered a plea of guilty before Magisterial District Judge Timothy Clark to false report to law enforcement authorities, a misdemeanor of the third degree, and was ordered to pay a fine of $200 and court costs. Trooper Jaime Lopez of the Pennsylvania State Police arrested Smith for the offense in February 2010 following investigation of an incident that occured in Towanda Borough.
John Allen Gasper, 43, Troy, entered a plea of guilty before Magisterial District Judge Jonathan Wilcox to harassment, a summary offense, and was ordered to pay a fine and court costs totaling $337.00. Trooper Jaime Lopez of the Pennsylvania State Police arrested Gasper in Sylvania Borough on Feb. 12, 2010.
Mitchell S. Norton, 21, Canton, entered a plea of guilty before Magisterial District Judge Jonathan Wilcox to disorderly conduct, a misdemeanor of the third degree, and was ordered to pay a fine and court costs totaling $337.00 and to make restitution in the amount of $1812.00. Officer Michael Northup of the Troy Borough Police Department arrested Norton for the offense in December 2009
Justin A. Walter, 20, Laceyville, entered a plea of guilty before Magisterial District Judge Fred Wheaton to access device fraud, a misdemeanor of the third degree, and was sentenced to make restitution in the amount of $272 and pay court costs. Trooper Joshua Fisher of the Pennsylvania State Police arrested Walter for the offense in October 2009 following investigation of an incident that occurred in Wyalusing Township.
Bradford County District Attorney Daniel J. Barrett announced that the following persons entered pleas of guilty in the Bradford County Court of Common Pleas, Towanda:
Steven Stubbs, 37, Waverly, N.Y., entered a plea of guilty to driving under the influence of alcohol, third offense, a misdemeanor of the first degree, and fleeing or attempting to elude a police officer, a misdemeanor of the second degree. Stubbs will be sentenced following the preparation of a pre-sentence report by the Bradford County Probation Department. At sentencing, Stubbs faces a maximum sentence of up to seven years plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 30 months and any other conditions deemed appropriate by the sentencing court. Stubbs also faces an additional 12 month suspension of Pennsylvania driving privilege for refusing to submit to chemical testing of his blood at the time of his arrest. Additionally, Stubbs' parole for an earlier DUI offense in the State of New York has been revoked with the result that he has been incarcerated in New York State for the past 18 months. Trooper James Dughi of the Pennsylvania State Police arrested Stubbs for the offense in December 2008 following investigation of incidents that occurred in Ulster Township and Towanda Borough.
Brian Kithcart, 36, Sayre, entered a plea of guilty to driving under the influence of alcohol, a misdemeanor. Kithcart will be sentenced on May 3, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Kithcart faces a maximum sentence of up to six months plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 12 months, and any other conditions deemed appropriate by the sentencing court. Trooper Wayne Dunkling of the Pennsylvania State Police arrested Kithcart for the offense in September 2009 following investigation of an incident that occurred in Athens Township.
George Hush, 27, Afton, Mich., entered a plea of guilty to driving under the influence of controlled substance (marihuana), a misdemeanor of the first degree. Hush will be sentenced on May 3, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Hush faces a maximum sentence of up to five years plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 18 months, and any other conditions deemed appropriate by the sentencing court. Officer Floyd McDonald of the Troy Borough Police Department arrested Hush for the offense in November 2009 following investigation of a traffic stop.
William Harris, 20, Troy, entered a plea of guilty to retail theft, a misdemeanor of the second degree. Harris will be sentenced on May 3, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Harris faces a maximum sentence of up to two years plus fines(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Officer Floyd McDonald of the Troy Borough Police Department arrested Harris for the offense in November 2009.
Timothy Hamm, 25, Monroeton, entered a plea of guilty to simple assault, a misdemeanor of the second degree, and criminal mischief, a misdemeanor of the third degree. Hamm will be sentenced on May 3, 2010, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Hamm faces a maximum sentence of up to three years plus fine(s), costs, restitution to victims, and any other conditions deemed appropriate by the sentencing court. Sergeant Lance Larcom of the Canton Borough Police Department arrested Hamm for the offense in February 2009.
Harold Howell, 21, Towanda, entered a plea of guilty to disorderly conduct, a misdemeanor of the third degree. Howell will be sentenced on April 5, 2010, following preparation of a presentence report by the Bradford County Probation Department. Richard Johnson, 24, Towanda, entered a plea of guilty to possession of marijuana and possession of drug paraphernalia, each a misdemeanor. Johnson will be sentenced on April 15, 2009, following preparation of a presentence report by the Bradford County Probation Department. At sentencing, Johnson faces a maximum sentence of up to 24 months plus fine(s), costs, restitution to victims, loss of Pennsylvania driving privilege for at least 18 months, and any other conditions deemed appropriate by the sentencing court. Officer John Hennessey of the Towanda Borough Police Department arrested Johnson for the offense in July 2009.
Jessica Carnrike, 28, Waverly, N.Y., entered a plea of guilty to obstruction of administration of justice, a misdemeanor of the second degree. Ronald Bradley, 55, Sayre, entered pleas of guilty to driving under the influence of alcohol, second offense, a misdemeanor of the first degree, and resisting arrest, a misdemeanor of the second degree. Gary Johnson, Jr., 18, Towanda, was sentenced to Probation for a term of six months for impersonating a public servant, a misdemeanor of the second degree. The sentence was imposed following an earlier guilty plea. Sergeant Jack Strozyk of the Towanda Borough Police Department arrested Johnson for the offense in October 2001.
While on Probation, Johnson will be subject to supervision and monitoring by the Bradford County Probation Department.
Michael Kelly, 49, Wyalusing, was sentenced to Probation for a term of six months, and a fine of $300, for driving under the influence of alcohol, a misdemeanor. The sentence was imposed following an earlier guilty plea. Trooper Joseph Mitchell of the Pennsylvania State Police arrested Kelly for the offense in August 2009 after a incident in Wyalusing Township. While on Probation, Kelly will be subject to supervision and monitoring by the Bradford County Probation Department.
Alec Hess, 22, Canton, was sentenced to Probation for a term of 12 months, and a fine of $1000, for selling or furnishing alcoholic beverages to minors, a misdemeanor of the third degree. The sentence was imposed following an earlier guilty plea. Officer Brian Wibirt of the Canton Borough Police Department arrested Hess for the offense in July 2009.
Timothy M. Friends, 24, Troy, was sentenced to Probation for a term of 18 months, and a fine of $500, for theft by unlawful taking, a misdemeanor of the first degree. The sentence was imposed following an earlier guilty plea. Officer Floyd McDonald of the Troy Borough Police Department arrested Friends for the offense in September 2009. While on Probation, Friends will be subject to supervision and monitoring by the Bradford County Probation Department.
Clarissa Park, 44, Towanda, was sentenced to Probation for a term of 12 months, and a fine of $300, for retail theft, a misdemeanor of the second degree. The sentence was imposed following an earlier guilty plea. Officer Roger Clink of the Athens Township Police Department arrested Park for the offense in July 2009. While on Probation, Park will be subject to supervision and monitoring by the Bradford County Probation Department.
Felicia O'Conner, 24, Mildred, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from 48 hours to six months, and a fine of $500, for driving under the influence of alcohol, a misdemeanor. O'Conner will also lose her Pennsylvania driving privilege for twelve months and she will be required to make restitution in an amount to be determined at a restitution hearing scheduled at time of sentencing. The sentence was imposed following an earlier guilty plea. Trooper Bryan Fedor of the Pennsylvania State Police arrested O'Conner for the offense in July 2008 after an incident in Smithfield Township. O'Conner may be eligible for parole after serving the minimum sentence, and, if paroled, she will be subject to supervision and monitoring by the Bradford County Probation Department.
Howard M. Hamm, 40, Troy, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from 40 days to six months and a fine of $1,000, for driving under the influence of alcohol (second offense). Hamm will also lose his Pennsylvania driving privilege for 12 months. The sentence was imposed following an earlier guilty plea. Sergeant Lance Larcom of the Canton Borough Police arrested Hamm for the offense in August 2009.
Daniel D. Shaffer, 48, Sayre, was sentenced to a term of imprisonment in a Pennsylvania State Correctional Facility of from nine months to 24 months for theft by unlawful taking, a misdemeanor of the second degree. The sentence was imposed following an earlier guilty plea. Officer Derek Watkins of the Sayre Borough Police Department arrested Shaffer for the offense in July 2009. Shaffer may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Pennsylvania Board of Probation and Parole.
Adrian Zwink, 41, Gillett, was resentenced to a term of imprisonment in the Bradford County Correctional Facility of from 15 days to 180 days, and a fine of $300, for driving under the influence of alcohol, a misdemeanor. The sentence was imposed following an earlier guilty plea. Trooper Joseph Pericci of the Pennsylvania State Police arrested Zwink for the offense in July 2008 after an accident in West Burlington Township. Zwink may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Bradford County Probation Department. Zwink was originally sentenced to a term of probation for the offense but his probationary status was revoked due to violation of probation conditions.
Mark Leonard, 54, Sayre, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from two months to 12 months, and a fine of $300, for disorderly conduct, a misdemeanor of the third degree. The sentence was imposed following an earlier guilty plea. Officer Jeremy Horton of the Sayre Borough Police Department arrested Leonard for the offense in September 2009. Leonard may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Bradford County Probation Department.
Michael P. McCarter, 23, Towanda, was sentenced to a total term of imprisonment in a Pennsylvania State Correctional Facility of from 14 months to 48 months to be followed by Probation for a term of 12 months, and a total fine of $1600, for statutory sexual assault, a felony of the second degree; terroristic threats, a misdemeanor of the first degree; fleeing or attempting to elude a police officer, a misdemeanor of the second degree; and criminal mischief, a misdemeanor of the third degree. McCarter was also ordered to pay restitution in the amount of $723.95 and he will lose his Pennsylvania driving privilege for 12 months. The sentence was imposed following earlier guilty pleas. Officer Derrick J. Kelley of the Towanda Borough Police Department and Corporal Michael Giantisco, Trooper Joshua Fisher, and Trooper David Pelachick of the Pennsylvania State Police arrested McCarter for the offenses on various dates in 2009 and 2010 after incidents that occurred throughout Bradford County. McCarter may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Pennsylvania Board of Probation and Parole. While on probation, McCarter will be supervised by the Pennsylvania Board of Probation and Parole.
Trevor Lamphere, Monroeton, was sentenced to a term of imprisonment in the Bradford County Correctional Facility of from 59 days to 12 months, and a fine of $1000, for furnishing alcoholic beverages to a minor, a misdemeanor of the third degree. The sentence was imposed following an earlier guilty plea. Lamphere was originally sentenced to a term of probation for the offense but his probationary status was revoked due to violation of probation conditions. Trooper Robert McKee of the Pennsylvania State Police arrested Lamphere for the offense in March 2009. Lamphere may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Bradford County Probation Department.
Dighton A. Lane, 81, Towanda, was sentenced to probation for a term of 6 months, and a fine of $300, driving under the influence of alcohol, a misdemeanor. The sentence was imposed following an earlier guilty plea. Trooper Joseph Mitchell of the Pennsylvania State Police arrested Lane for the offense in August 2009 after an incident in Monroe Township. While on Probation, Lane will be subject to supervision and monitoring by the Bradford County Probation Department.
Jeffrey Mazonis, 36, Sayre, was sentenced to Probation for a term of 9 months, and a fine of $300, for access device fraud, a misdemeanor of the first degree. Mazonis was also ordered to pay restitution of $1057.87. The sentence was imposed following an earlier guilty plea. Officer Daniel Thomas of the Athens Township Police Department arrested Mazonis for the offense in August 2009. While on Probation, Mazonis will be subject to supervision and monitoring by the Bradford County Probation Department.
Bernard Godfrey, 38, Sayre, was sentenced to a term of imprisonment in a Pennsylvania State Correctional Facility of from 24 months to 20 years for two counts of indecent assault and two counts of corruption of minors, each count a misdemeanor of the first degree. The sentence was imposed following earlier guilty pleas. Officer Jeremy Horton of the Sayre Police Department arrested Godfrey for the offense in February 2009. Godfrey may be eligible for parole after serving the minimum sentence, and, if paroled, he will be subject to supervision and monitoring by the Pennsylvania Board of Probation and Parole.
Bradford County District Attorney Daniel J. Barrett announced that the following persons were placed in the Accelerated Rehabilitative Disposition (ARD) Program on March 15 and 18, 2010, in the Bradford County Court of Common Pleas, Towanda:
Jack Johnson, 18, Towanda, charged with theft by unlawful taking in July 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Johnson must perform 40 hours of community service and pay restitution in the amount of $2180.18. Trooper Robert McKee of the Pennsylvania State Police arrested Johnson for the offense following investigation of a theft that occurred in Wysox Township.
Adam Chilson, 18, Towanda, charged with theft by unlawful taking in July 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Chilson must perform 40 hours of community service. Trooper Robert McKee of the Pennsylvania State Police arrested Chilson for the offense following investigation of a theft that occurred in Wysox Township.
Linda Dodge, 56, Monroeton, charged with driving under the influence of alcohol in December 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of nine months. While in the ARD Program, Dodge must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel; he will also lose his Pennsylvania driving privilege for 30 days. Chief Douglas Seeley of the Canton Borough Police Department arrested Dodge for the offense.
Tiffany Jenner, 25, Wyalusing, charged with driving under the influence of alcohol in November 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Jenner must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel; she will also lose his Pennsylvania driving privilege for 60 days. Trooper David Sweeney of the Pennsylvania State Police arrested Jenner for the offense following investigation of a motor vehicle crash that occurred in Wysox Borough.
Joseph Miksis, 45, Towanda, charged with simple assault by menacing in September 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Miksis must perform 40 hours of community service. Trooper David Sweeney of the Pennsylvania State Police arrested Miksis for the offense following investigation of a theft that occurred in Sheshequin Township.
Susan Sane, 51, Laceyville, charged with driving under the influence of alcohol in December 2009, was accepted into the ARD Program and placed on Probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Sane must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel; she will also lose her Pennsylvania driving privilege for 60 days. Trooper James Dughi of the Pennsylvania State Police arrested Sane for the offense following investigation of a motor vehicle crash that occurred in Tuscarora Township.
Matthew Williams, 29, Monroeton, charged with driving under the influence of alcohol (first offense), was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Williams must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel; he will also lose his Pennsylvania driving privilege for 60 days. Trooper Thad Warnick of the Pennsylvania State Police arrested Williams for the offense following investigation of a motor vehicle crash that occurred in North Towanda Township.
Ralph L. Taylor, 24, South Waverly, N.Y., charged with driving under the influence of alcohol in November 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. While in the ARD Program, Taylor must perform community service with the DUI Litter Brigade and attend a Victim Impact Panel; he will also lose his Pennsylvania driving privilege for 60 days. Officer Bruce Hoffman of the Sayre Borough Police Department arrested Taylor for the offense following investigation of a traffic violation.
Alden E. Eberlin, 68, New Albany, charged with simple assault in November 2009, was accepted into the ARD Program and placed on probation under the supervision of the Bradford County Probation Department for a term of 12 months. Trooper Franklin Harvey of the Pennsylvania State Police arrested Eberlin for the offense following investigation of an incident that occurred in Terry Township.
Bradford County District Attorney Daniel J. Barrett announced that the following persons were found not guilty after jury trials:
Trevor Webster, 29, of Towanda, was found not guilty of driving under the influence of alcohol after a jury trial presided over by the Honorable Maureen Beirne. Webster will, however, lose his Pennsylvania driving privilege for 12 months for refusing to submit to blood alcohol testing at the time of his arrest. Trooper Wayne Dunkling of the Pennsylvania State Police arrested Webster for the offense following investigation of an incident that occurred in Towanda Township.
Matthew Miller, 29, Towanda, was found not guilty of possession of drug paraphernalia (marijuana-related), a misdemeanor, after a jury trial in the Bradford County Court of Common Pleas. Miller was charged with the offense on the basis of his pre-arrest statement to the police that the controlled substance-related items found in his car belonged to him. At trial, however, Miller asserted that the items belonged to someone else. Following the trial, Miller was charged with hindering a criminal investigation by lying to the police when he initially claimed ownership of the paraphernalia for the possession of which he was arrested.
Bradford County District Attorney Daniel J. Barrett announced that criminal charges filed against the following person have been withdrawn:
Counts of Possession of Marijuana and Possession of Drug Paraphernalia, each a misdemeanor, filed against Christopher Johnson, 20, Towanda, were withdrawn by the Commonwealth on March 16, 2010. The charges were withdrawn because, at the time of withdrawal, Johnson had served four months in the Bradford County Correctional Facility dating from the time of his arrest and he had cooperated with the Commonwealth in the prosecution of another case. Trooper James Dughi of the Pennsylvania State Police arrested Johnson for the offense in September 2009 following investigation of an incident that occurred in Athens Borough.
Bradford County District Attorney Daniel J. Barrett announced that the following person entered a plea of Nolo Contendere in the Bradford County Court of Common Pleas on March 22, 2010. A plea of Nolo Contendere has the same legal effect as a guilty plea. A defendant entering a plea of Nolo Contendere, while not admitting to the specific facts of the offense(s) alleged, concedes that he/she will probably not be able to overcome evidence of his/her guilt offered by the Commonwealth at trial.
Arthur K. Lattimer, 44, Gillett, entered a plea of Nolo Contendere to driving under the influence of alcohol, a misdemeanor. Lattimer will be sentenced on May 17, 2010, after preparation of a presentence report by the Bradford County Probation Department. At sentencing, Lattimer faces a maximum sentence of up to six months plus fine(s), costs, restitution to victims, and any other sanction deemed appropriate by the sentencing court. Trooper Bryan Fedor of the Pennsylvania State Police arrested Lattimer for the offense in August 2009 following an incident that occurred in Ridgebury Township.
